DETROIT LAKES, MN--The man arrested in Detroit Lakes earlier this week after being found in a school zone with a gun has been officially charged in Becker County District Court. One felony count of felon in possession of a firearm or ammo, and a count of Obstruction of legal process, a gross misdemeanor were filed against 37 year old James Andrew Poitra of Detroit Lakes on Thursday. Poitra was arrested Tuesday after police were called to the report of a suspicious male who'd been sleeping in the back of a vehicle at the Food 'n Fuel gas station parking lot for three hours. According to the incident complaint filed in Becker County District Court, one of the responding officers recognized the vehicle as one Poitra had been driving as a citation was recently issued to Poitra. The same officer located three active warrants on Poitra. As the two Detroit Lakes Police officers arrived on scene, one tapped on the window to wake Poitra and the other officer observed a gun lying underneath Poitra. The officers immediately stepped away from the vehicle and told Poitra to exit. Poitra didn't immediately exit. In the meantime, other officers from multiple agencies arrived to set up a perimeter around the scene, which was a block from a middle and elementary school which was just releasing students at the end of the day and directly across Highway 34 from the M-State campus. Poitra eventually exited the vehicle and allegedly resisted arrest. An officer tackled Poitra to make the arrest. Poitra continued to resist and allegedly caused damage to a squad prior to being transported to jail. While being booked into the jail, an officer found six live rounds of 32-caliber ammunition. Court documents state at the incident scene, an officer recovered a silver 32-caliber revolver on the seat where Poitra had been seated in the vehicle. Poitra was convicted in 1999 of 2nd degree assault and is prohibited for life from possession of any firearm or ammunition. Thursday bail was set without conditions at $100,000; bond with conditions was set at $50,000; bail with conditions is $5,000. Poitra's next court appearance is set for April 9th.
