Perham Man Is Charged with Criminal Vehicular Homicide

UNDATED--Formal Charges were filed Wednesday against the Perham man behind the wheel of a vehicle involved in a crash that caused the death of an Anderson Bus Employee in Frazee on Monday. Two counts of Criminal Vehicular Homicide were filed in Becker County District Court against 39 year old Richard Henry Fisette during his first court appearance on Wednesday following his arrest Monday after an early morning two vehicle accident in Frazee that killed 50 year old Marlin Miller of Ponsford while he waited in his vehicle to go to work.
According to court documents filed in the case, just before 6:00am Monday, a vehicle driven by Fisette struck the front drivers side of a parked vehicle occupied by Miller, pushing that vehicle into two others behind it. Records allege Fisette told a Becker County Deputy at the scene he was traveling about 35 mph on Juniper Avenue and his tire blew and lost control. He also allegedly admitted to the deputy that he had smoke marijuana and meth the day before and that he hadn't slept much. According to a witness at the scene Fisette's vehicle lights were off. A warrant was obtained to draw a blood sample from Fisette and the sample was sent to the Minnesota Bureau of Criminal Apprehension for analysis.
Bail was set Wednesday at 100-thousand dollars without conditions and at 50-thousand with conditions. Fisette's next court date is November 19th.
